ERISA at a glance

The Employee Benefits Security Administration (EBSA) is responsible for administering and enforcing the fiduciary, reporting and disclosure provisions of Title I of the Employee Retirement Income Security Act of 1974 (ERISA). ERISA covers retirement plans (including traditional defined benefit pension plans and individual account plans such as 401(k) plans) and welfare benefit plans (e.g., employment based medical and hospitalization benefits, apprenticeship plans, and other plans described in section 3(1) of Title I). Plan sponsors must design and administer their plans in accordance with ERISA. Title II of ERISA contains standards that must be met by employee retirement benefit plans in order to qualify for favorable tax treatment. Noncompliance with these tax qualification requirements of ERISA may result in disqualification of a plan and/or other penalties. Through its enforcement of the Employee Retirement Income Security Act (ERISA), EBSA is responsible for ensuring the integrity of the private employee benefit plan system in the United States. EBSA’s oversight authority extends to nearly 722,000 retirement plans, approximately 2.5 million health plans, and a similar number of other welfare benefit plans, such as those providing life or disability insurance. These plans cover about 154 million workers and their dependents and include over $10.7 trillion in assets. Total monetary recovery by EBSA totaled $2.57 billion and $3.12 billion in fiscal years 2019 and 2020, respectively.

Justine Kim is CEO and Founder of JSK ERISA Consulting Services. Ms. Kim holds a Bachelor of Arts degree in Political Science from San Francisco State University and a Juris Doctor degree from Southwestern University School of Law. Ms. Kim started her career as an investigator with Employee Benefits Security Administration (EBSA) in 2006 and was promoted to a senior investigator in 2011. During her time with EBSA, Ms. Kim conducted hundreds of investigations relating to all types of ERISA- covered employee benefit plans, including but not limited to, 401(k) plans, profit sharing plans, multiemployer plans, MEWAs, and defined benefit plans. Ms. Kim has extensive ERISA knowledge and expertise, particularly with respect to issues including but not limited to delinquent 401k contributions, terminated vested participants, conflict of interest, prohibited transactions, real estate investment, and alternative investment. Ms. Kim also brings significant experience in matters related to navigating DOL EBSA investigations and ERISA compliance matters.
Ms. Kim was known for her ability and skills in obtaining compliance and correction from investigation subjects and related parties. She found violations in more than 98% of her cases and achieved voluntary correction in all her investigations. In addition, she led multiple regional and national projects including 401(k) project with great success and trained new investigators in 401(k) employee contribution issues. In Fiscal year 2017, Ms. Kim was the #1 investigator in bringing in the largest monetary recovery in the Los Angeles Regional Office. She is known for investigating complex issues, large plans, and conducting investigations in a short time.
